    Caterpillar 4Q earnings fall by half

    MINNEAPOLIS (AP) ? Caterpillar's fourth-quarter net income fell by half after it took a big charge for a deal in China that went bad, and because of slower growth in China and economic uncertainty in the U.S. and Europe.

    Still, its adjusted profit and revenue were better than analysts expected. And while cautious about the global economic outlook, Caterpillar does expect conditions to pick up later in the year, outside of Europe. Shares rose 2.4 percent in premarket trading.

    Caterpillar Inc. makes construction and mining equipment as well as power generators, so its growth rises and falls with the world's economy.

    For the fourth quarter, Caterpillar earned $697 million, or $1.04 per share. That was down from a profit of $1.55 billion, or $2.32 per share a year earlier.

    Revenue fell 7 percent to $16.08 billion as dealers reduced inventory.

    The most recent quarter included a non-cash charge of 87 cents per share to write down the purchase of Zhengzhou Siwei. Not counting that, analysts surveyed by FactSet had been expecting a profit of $1.70 per share.

    Caterpillar's purchase of Siwei last year gave it a new business ? roofing supports for mines ? in a country where mining is growing quickly. But on Jan. 18, Caterpillar said it had found "deliberate, multi-year, coordinated accounting misconduct" in the accounting at Siwei, and said it will write down its investment in the company by $580 million. It also said it dismissed several senior managers at the company.

    For this year, Caterpillar expects revenue of $60 billion to $68 billion, with a profit of $7 to $9 per share.

    Analysts had been expecting a profit of $8.54 per share on revenue of $64.58 billion.

    Caterpillar said there's a wide range in its outlook because of the high level of uncertainty in the world. It expects relatively weak growth in the U.S. economy. Growth in China will improve, but not back to the levels seen in 2010 or 2011, Caterpillar said.

    For all of 2012, the company's profits rose 15 percent to $5.68 billion, or $8.48 per share, up from $4.93 billion, or $7.40 per share, in 2011. Revenue rose 10 percent to $65.88 billion, from $60.14 billion.

    Shares of the Peoria, Ill.-based company rose $2.32 to $97.90 in premarket trading.

    US stocks close mixed on uneven economic signals

    U.S. stocks meandered between small gains and losses Monday, cooling off after a rally that had pushed the Standard & Poor's 500 index above 1,500 for the first time since December 2007. Encouraging news about manufacturing provided an early boost, but stocks fell later after a report on the pace of home sales fell short of expectations.

    The government said before trading began that orders for long-lasting goods rose in December by 4.6 percent, helped by a 10 percent gain in orders for new aircraft. The report was a sign of strength for the manufacturing sector, a crucial driver of economic growth.

    Heavy equipment maker Caterpillar said separately that its fourth-quarter net income exceeded analysts' expectations, after adjusting for the cost of a soured deal to buy a Chinese maker of roofing supports for mines. Caterpillar said it took a big charge in the quarter because the Chinese company had misrepresented its finances.

    Caterpillar Inc. said it expects growth in China to improve without regaining the levels seen in 2010 or 2011. The stock was the biggest gainer in the Dow Jones industrial average, closing up $1.87, or 2 percent, at $97.45.

    The Dow Jones transportation index, a proxy for future economic activity, edged higher, notching its tenth straight increase and its twelfth gain in the past 13 trading days.

    A half-hour after trading began, the National Association of Realtors said that its index of pending home sales fell in December, suggesting that sales of previously occupied homes may slow in the coming months. The report, which was weaker than many economists had expected, helped push stocks lower for much of the morning. They were roughly flat by midday, and spent the afternoon swapping small bumps and dips.

    The Dow closed down 14.05 points, or 0.1 percent, at 13,881.93. The S&P 500 fell 2.78, or 0.2 percent, to 1,500.18. The Nasdaq composite index added 4.59, or 0.2 percent, to 3,154.

    The Dow and the S&P 500 are rapidly approaching their all-time closing highs, reached on Oct. 9, 2007. The Dow is about 282 points below its high of 14,164.53; the S&P 500 is 65 points shy of its record of 1,565.

    Economic data may be less likely to boost the indexes because traders have become harder to impress as the data have strengthened in recent weeks, said Bill Stone, chief investment strategist with PNC Asset Management Group.

    "Before, even if you came in just at expectations, that was like a victory," he said. Because of the market's recent upturn, he said, "you get less of a pop for just making the numbers."

    Among companies in the S&P 500 that reported earnings Monday, Biogen Idec Inc. said its fourth-quarter net income slipped nearly 3 percent because of a tax charge and higher expenses. Still, the biotech drug maker rose $3.79, or 2.6 percent, to $149.99.

    Roper Industries Inc., which makes medical and industrial equipment, said its fourth-quarter net income rose 18 percent. But the company issued mixed guidance for the current quarter and full year 2013. It fell 33 cents to $118.50.

    Oil company Hess Inc. was the biggest gainer in the S&P 500, adding 6.1 percent after the company said it plans to sell its U.S. terminal network, shutter its New Jersey refinery and continue shifting its focus to exploration and production. Hess also said that the hedge fund Elliott Associates plans to seek regulatory approval to buy a major stake in the company. Hess rose $3.58 to $62.48.

    Several big tech companies reported their results after the market closed and saw big price swings in after-hours trading:

    ? Web portal Yahoo Inc. rose 81 cents, or 4 percent, to $21.12 after saying its fourth-quarter earnings topped analyst estimates as an upturn in its international investments helped end a three-year revenue slump.

    ? Hard disk maker Seagate Technology PLC said it beat analysts' estimates in its results for the fiscal second quarter ended Dec. 28. It rose 69 cents, or 1.8 percent, to $38.10 after hours.

    ? Cloud computing provider VMWare Inc. said its net income edged higher, but the company announced guidance that was far weaker than analysts had expected. VMWare lost $10.83, or 11 percent, to $87.49 after hours.

    Strong corporate earnings helped push the S&P 500 through the 1,500 milestone Friday after several calm, relatively news-free weeks. In addition to companies' performance, traders have been encouraged by signals that housing market is improving steadily and hiring is picking up, albeit slowly.

    There will plenty of fresh data to drive trading this week, including retail sales, economic growth and the government's report on hiring and employment in January, which is due out Friday. More than one-fifth of the companies in the S&P 500 will report fourth-quarter earnings this week.

    Stone said stocks are trading sideways in part because many investors are awaiting economic reports later this week, especially the employment report. There is agreement among economists and analysts that the economy slowed in the fourth quarter, he said, and this week's numbers will help answer the question of "how slow, and how much did it impact employment."

    The yield in the benchmark 10-year Treasury note rose to 1.97 percent from 1.95 percent late Friday, reflecting lower demand for ultra-safe investments. After Monday's factory orders report, the yield rose briefly above 2 percent for the first time since April. A bond's yield rises as demand for it decreases.

    Vicki Larson: The Best Relationship To Have After Divorce

    "So, what are you and 'J' going to do?" a friend asked recently.

    "J" is my boyfriend and we do a lot of things, some of which I'm much too discreet to discuss publicly. I needed clarification.

    "What do you mean?"

    "Are you ever going to get married or live together or something like that?"

    Oh, that question. It's not the first time I've heard it. "J" and I have been in a committed monogamous relationship for almost eight years (well, with a year of non-monogamy early on), and he lives in his house and I live in mine. Neither of us wants to get married -- he's done it once and I've done it twice -- and we're not sure we want to live together either.

    Our relationship doesn't look like a relationship is "supposed" to look like, and so people feel uncomfortable about it.

    "Why don't you want to live together?" After all, isn't that what people who love each other do?

    Relationships used to be that way, when we had little choice. But since there are so many ways to be a couple now, why do we still think they have to be that way? And once you're divorced with kids, there are many compelling reasons not to have your relationship look like that.

    When his and my kids were young, mashing two families together seemed, well, scary. I know people do it all the time, creating their own versions of the Brady Bunch to various degrees of success. But since 60 percent of all second marriages end in divorce, and since blended families often create a mess for everyone -- you, your new spouse, your former spouse and his/her new spouse, as well as the kids -- and since second marriages don't necessarily lead to marital satisfaction, why would I want to marry again?

    Oh sure, we could have lived together. That's not the message I wanted to send to my kids, however. Plus, the idea of putting them through another split if things didn't work out was too painful to even think about; one divorce for kids is more than enough.

    It's not to say that sometimes I don't long to come home to what seems familiar -- someone to share stories of our day with over dinner and a warm body to snuggle next to every night instead of three or four a week. There are many pleasures that come with living with someone, which, between my two marriages, I did for nearly 20 years.

    And then there are the not-so-pleasurable things that come from living with someone for years.

    We start to get annoyed by their habits -- you know, the ones they always had, the ones we used to find "charming." We complain that they're not doing their share of (insert child-care, cleaning, yard work, laundry, etc., here). We get upset because they're spending too much time (insert watching sports, on the computer, playing video games, hanging out with friends, fussing over the kids, shopping, etc., here). All of those things lead to disappointment, anger, maybe even resentment, and so we stop having sex. And we start taking each other for granted.

    Don't think cohabiting gets you off the hook, either; you don't have to be married to take each other for granted, as Susan Sarandon discovered after splitting from Tim Robbins after 23 years of cohabitation and having two children together.

    "I thought that if you didn't get married you wouldn't take each other for granted as easily. I don't know if after twenty-something years that was still true," she told The Telegraph in 2010.

    But, marriage, the institution, doesn't make us do or not do anything; the people in the marriage are responsible for how they act. Taking each other for granted is not part of any marriage vow as far as I know.

    Maybe the problem is living together.

    A new study seems to confirm what "J" and I already know -- couples that live apart are happier in their relationship than couples that live together, and they also feel more committed and less trapped. When you live apart, you actively work on commitment and trust; it's never taken for granted. You have time for yourself. And because sex whenever you want it isn't as available to you as it is when you live with someone, you don't let too many opportunities to actually have it pass you by.

    So when people ask me, "Are you ever going to get married or live together or something like that?" I guess I'll have to continue to answer, "Something like that."

    We're free to create the relationship we want post-divorce. I've created mine -- have you created yours?

    Rock singer Morrissey postpones six more shows due to bleeding ulcer

    LOS ANGELES (Reuters) - British rock singer Morrissey is postponing six performances on his U.S. tour due to a bleeding ulcer, his spokeswoman said on Sunday.

    "Morrissey is expected to make a full recovery and thanks everyone concerned for their support during this time," his representative Lauren Papapietro said in a statement.

    Morrissey, the former lead singer for 1980s alternative rock band The Smiths, checked into Beaumont Hospital on Friday in the Detroit suburb of Royal Oak, Papapietro said.

    She declined to say if he remains hospitalized.

    Due to his bleeding ulcer, Morrissey is postponing his upcoming shows in Asheville, North Carolina; Nashville, Tennessee; Atlanta, Georgia; Lawrence, Kansas; Clear Lake, Iowa; and Lincoln, Nebraska, Papapietro said.

    He plans to resume his tour on February 9 in Las Vegas.

    Due to an illness in his band, Morrissey, 53, canceled his show Thursday in Flint, Michigan, and postponed a Friday night performance in Minneapolis and another engagement set for Saturday night in Chicago, Papapietro said.

    Morrissey, whose hits include "First of the Gang to Die" and "Irish Blood, English Heart," toured North America last fall, played some shows in Australia and New Zealand in December and returned to the United States this month.

    He kicked off his latest tour with a performance of his unreleased song "Action is My Middle Name" on "The Late Show with David Letterman" in New York.

    Ben Shapiro: Boston Celtics: Will Rajon Rondo's Injury End the Team's Playoff Hopes?

    Of all the players on the Boston Celtics, Rajon Rondo was probably the most irreplaceable talent.

    That's doesn't matter anymore.

    Sunday afternoon the Boston Celtics tweeted the bad news that Rajon Rondo, the team's All-Star point guard -- and one the NBA's best all around basketball players -- has suffered a torn anterior cruciate ligament and will miss the remainder of the 2012-13 season.

    For a Celtics team that had struggled all season to work new players into their system, and get consistent play from their aging veterans the news could not be worse.

    Now Boston must face some very tough choices.

    Are the Celtics prepared to try and trade for a point guard to fill in for the remainder of the season? Can Avery Bradley, a player known mainly for his defense fill-in at the point guard position?

    The Celtics could also decide to shop veteran small forward Paul Pierce. Pierce can become a free agent following this season's conclusion. Now in his 15th season as a Celtic. He is the franchise's second all-time leading scorer. Dealing Pierce was signal the end of an era in Boston.

    Ken Berger of CBS Sports has already suggested that Pierce could be traded to Memphis in exchange for Rudy Gay.

    There is little chance the Celtics will find an adequate replacement for Rondo, whose 11.1 assists per game lead the NBA.

    Avery Bradley figures to receive the bulk of minutes at point guard in the short-term. Bradley doesn't have much experience running the point, but he's a stellar defender and great athlete.

    It was Bradley's emergence that forced veteran Ray Allen out of the starting lineup last spring.

    Now Celtics Head Coach Doc Rivers will turn to Bradley again, and this time the challenge will be even more daunting.

    Can Bradley handle the increased pressure of defending opposing point guards during a time of unprecedented depth and talent in the NBA at the position?

    Can Bradley efficiently distribute the ball to a Celtics roster that features two future hall of fame players in Paul Pierce and Kevin Garnett, veterans Jason Terry and Courtney Lee and young players such as Jeff Green and rookie Jared Sullinger?

    With the Celtics' playoff status already in a precarious position, there will be plenty of people who will suggest the Celtics basically give-up on this season.

    When head coach Doc Rivers was asked by Yahoo Sports Adrian Wojnarowski about writing-off this season following the news of Rondo's injury, he responded that he wasn't ready to do that.

    "You can write the obituary, but I'm not."

    WIth a roster that has young talent and veteran leadership, as well as one of the NBA's more accomplished head coaches, the Celtics aren't ready to turn the page on the 2012-13 season. Replacing Rondo will be next to impossible, but the team is determined to make an effort.

    That was apparent on Sunday afternoon when the Rondo-less Celtics knocked off the defending NBA Champion Miami Heat in a double-overtime thriller in Boston.

    How much momentum the Celtics can take from Sunday afternoon's win is a big question. The win snapped a six-game losing steak and featured a triple-double from Paul Pierce, but the real test is yet to come.

    There are 38 games remaining in the regular season and the Celtics will need to play better basketball without Rajon Rondo than they were playing with the All-Star point guard. That's not going to be easy.

    MELBOURNE, Australia (AP) ? Novak Djokovic returned to his dominant best to win his third consecutive Australian Open title, denying Andy Murray a second major championship with a 6-7 (2), 7-6 (3), 6-3, 6-2 victory Sunday night at Rod Laver Arena.

    The top-ranked Djokovic is the first man in the Open era to win three straight Australian titles.

    Born a week apart in May 1987 and friends since their junior playing days, the two played like they knew each other's game well in a rematch of last year's U.S. Open final won by Murray. There were no service breaks until the eighth game of the third set, when Djokovic finally broke through and then held at love to lead by two sets to one.

    Djokovic also secured the second break of the match to take a 2-1 lead in the fourth set then went ahead by two service breaks and took a 4-1 lead when Murray double-faulted on break point.

    Top-ranked Djokovic didn't rip his t-shirt off this time, as he did after his epic 5-hour, 53-minute win over Rafael Nadal last year. He just did a little dance, looked up to the sky and then applauded the crowd after the 3-hour, 40-minute match.

    It was Djokovic's sixth major title and his fourth at Melbourne Park, where he is unbeaten in 21 matches.

    Murray's win over Djokovic in the U.S. Open final last year ended a 76-year drought for British men at the majors. The 25-year-old Scotsman has now lost three Australian Open finals.

    New mutations discovered driving malignant melanoma

    Jan. 24, 2013 ? Two new mutations that collectively occur in 71 percent of malignant melanoma tumors have been discovered in what scientists call the "dark matter" of the cancer genome, where cancer-related mutations haven't been previously found.

    Reporting their findings in the Jan. 24 issue of Science Express, the researchers from Dana-Farber Cancer Institute and the Broad Institute said the highly "recurrent" mutations -- occurring in the tumors of many people -- may be the most common mutations in melanoma cells found to date.

    The researchers said these cancer-associated mutations are the first to be discovered in the vast regions of DNA in cancer cells that do not contain genetic instructions for making proteins. The mutations are located in non-protein-coding DNA that regulates the activity of genes.

    This non-coding DNA, much of which was previously dismissed as "junk," accounts for 99 percent of a cell's genome. A large number of oncogenic mutations in cancer have been identified in the past several decades, but all have been found within the actual genetic blueprints for proteins.

    "This new finding represents an initial foray into the 'dark matter' of the cancer genome," said Levi Garraway, MD, PhD, of Dana-Farber and the Broad and the article's senior author.

    "In addition, this represents the discovery of two of the most prevalent melanoma gene mutations. Considered as a whole, these two TERT promoter mutations are even more common than BRAF mutations in melanoma. Altogether, this discovery could cause us to think more creatively about the possible benefits of targeting TERT in cancer treatment or prevention."

    The mutations affect a promoter region -- a stretch of DNA code that regulates the expression of a gene -- adjacent to the TERT gene. TERT contains the recipe for making telomerase reverse transcriptase, an enzyme that can make cells virtually immortal, and is often found overexpressed in cancer cells. A promoter region of DNA controls the rate of a gene's transcription -- the copying of its DNA recipe into a message used by the cell to manufacture a protein.

    "We think these mutations in the promoter region are potentially one way the TERT gene can be activated," said Franklin Huang, MD, PhD, co-first author of the report along with Harvard MD-PhD student Eran Hodis, of Dana-Farber and the Broad Institute.

    To investigate the mutation's effect, the researchers hooked the mutant TERT promoter to a gene that makes luciferase -- a light-emitting protein. They observed that the mutant promoter increased the production of luciferase in laboratory cell lines. In the same way, the scientists presume, the mutant promoter in human pigmented skin cells can send the TERT gene into overdrive, potentially contributing to the development of melanoma.

    The mutations were discovered when the scientists sifted through data from whole-genome sequencing of malignant melanoma tumors. Unlike "whole-exome" searches that examine only the protein-coding DNA of a cell's genome, whole-genome searches scan all of the DNA, including the non-coding regions.

    In analyzing whole-genome data, the investigators discovered the two somatic, or not-inherited, mutations in 17 of 19 (89 percent) of the tumors. Next, they sequenced a larger number of melanoma tumors and found that the two mutations were present in 71 percent of tumors in total.

    The researchers said the same mutations are present in cell lines from some other malignancies, and that preliminary evidence showed they might be unusually common in bladder and liver cancers. They also noted that the discovery of these important mutations in DNA previously not linked to cancer-causing alterations highlights the value of whole-genome searches of tumor DNA.

    Other authors include Mary Jue Xu, a student at Harvard Medical School; Gregory V. Kryukov, PhD, of the Broad; and Lynda Chin, MD, of M.D. Anderson Cancer Center.

    'SpaceLiner' aims to fly passengers in 2050

    A??hypersonic "SpaceLiner" would whisk up to 50 passengers from Europe to Australia in 90 minutes. The futuristic vehicle would do so by riding a rocket into Earth's upper atmosphere, reaching 24 times the speed of sound before gliding in for a landing.

    Many challenges still remain, including finding the right shape for the vehicle, said Martin Sippel, project coordinator for SpaceLiner at the German Aerospace Center. But he suggested the project could make enough progress to begin attracting private funding in another 10 years and aim for full operations by 2050.

    The current concept includes a rocket booster stage for launch and a separate orbiter stage to carry passengers halfway around the world without ever making it to space. Flight times between the U.S. and Europe could fall to just over an hour if the SpaceLiner takes off ? that is, if passengers don't mind paying the equivalent of space tourism prices around several hundred thousand dollars.

    "Maybe we can best characterize the SpaceLiner by saying it's a kind of second-generation space shuttle, but with a completely different task," Sippel said.

    SpaceLiner passengers would have eight minutes to experience the rocket launch before they reached an altitude of about 47 to 50 miles. That falls short of the 62-mile boundary considered the edge of space, but even a suborbital flight would allow SpaceLiner to glide back to Earth at hypersonic speeds of more than 15,000 mph.

    Relying on rocket power

    The rocket-powered design stands out compared with other proposed hypersonic jets, which feature new air-breathing engine concepts. European aerospace giant EADS previously unveiled a hypersonic jet concept that would rely mainly upon air-breathing ramjets to reach cruising speeds of Mach 4 ? faster than the supersonic Concorde's Mach 2 performances but far slower than the SpaceLiner's Mach 24 goal.

    SpaceLiner's European project planners say their reliance upon proven rocket technology could allow their vehicle to fly sooner rather than later. They plan to use liquid oxygen and hydrogen rocket propellants so that the rocket engines leave only water vapor and hydrogen in the atmosphere.     "We will not try to improve the performance of the engine but would like to have it more reusable," Sippel told TechNewsDaily.

    The empty rocket stage from SpaceLiner would return to Earth immediately after launch in preparation for reuse. An aircraft could grab the rocket stage in midair, tow it toward an airfield and release it for an autonomous gliding landing.

    Chances of survival

    But big challenges remain before SpaceLiner can take off. Researchers first must finalize a design shape capable of surviving the intense heat created by gliding at hypersonic speeds through the upper atmosphere. New cooling technologies and improved heat shielding for SpaceLiner's wing "leading edge" could help in that case.

    Launching like a rocket rather than taking off like an aircraft means SpaceLiner would remain restricted to suitable launch sites with uninhabited areas down range. The SpaceLiner also would need a careful flight path during its final landing approach ? the "sonic boom" shock that accompanies aircraft traveling faster than the speed of sound can damage buildings on the ground at low altitudes.

    "The profile of the vehicle is very similar to a rocket-propelled vehicle," Sippel explained. "We only have a small corridor in which we can fly safely and economically."

    SpaceLiner's design will make use of study results from a FAST20XX (Future High-Altitude High-Speed Transport 20XX) project funded by the European Union and backed by researchers from Germany, Austria, Spain, Switzerland, Italy, Belgium, the Netherlands, France and Sweden. It can also draw lessons from upcoming efforts such as Project ALPHA by Aerospace Innovation GmbH ? a space plane that aims to launch in midair from an Airbus A330 aircraft.

    But future success ultimately depends upon the success of space tourism efforts by companies such as Virgin Galactic. If enough people prove willing to pay top dollar for suborbital flights as part of their travels around the world, Sippel envisions a fleet of SpaceLiners eventually making 10 to 15 flights per day.

    Wal-Mart tightens supplier policy after factory fire: WSJ

    (Reuters) - Wal-Mart Stores Inc plans to cut ties immediately with suppliers who subcontract work to factories without the retailer's knowledge, changing its policy after a fire killed more than 100 garment workers in Bangladesh, the Wall Street Journal reported.

    Wal-Mart is warning suppliers that it is adopting a "zero tolerance policy" for violations of its global sourcing standards and the company's new plan would begin taking effect from March 1, the Journal said.

    The tougher code replaces Wal-Mart's prior "three strikes" approach to policing suppliers, which gave the suppliers three chances to address problems before being terminated. (http://link.reuters.com/wyh45t)

    "Obviously our three-strike policy wasn't working as well as it could have," Rajan Kamalanathan, Wal-Mart's vice president of ethical sourcing, told the Journal in an interview. "Our message of zero tolerance is meant to get people's attention."

    Wal-Mart could not be reached for comment by Reuters outside of regular U.S. business hours.

    More than 100 workers were killed in a November 24 fire at the Tazreen garment factory in Bangladesh. Wal-Mart has said repeatedly that its Faded Glory clothing should not have been in production at the factory, a facility Bangladeshi authorities said was not safe for use.

    Obama Promises Climate Change Action

    President Obama's inauguration speech was broad, as such addresses tend to be, but he got specific when it came to climate change.

    In his second inaugural address, the president mentioned the recent wave of severe weather that some have linked to global warming. From his address, as prepared for delivery:

    We will respond to the threat of climate change, knowing that the failure to do so would betray our children and future generations. Some may still deny the overwhelming judgment of science, but none can avoid the devastating impact of raging fires, and crippling drought, and more powerful storms.

    The path towards sustainable energy sources will be long and sometimes difficult. But America cannot resist this transition; we must lead it. We cannot cede to other nations the technology that will power new jobs and new industries - we must claim its promise. That is how we will maintain our economic vitality and our national treasure - our forests and waterways; our croplands and snowcapped peaks. That is how we will preserve our planet, commanded to our care by God. That's what will lend meaning to the creed our fathers once declared.

    Talking about climate change as a pressing issue is a new thing for a presidential inaugural address. Obama made passing mention of it four years ago, during his first inaugural address in 2009, and Bill Clinton mentioned the environment.

    "With old friends and former foes, we'll work tirelessly to lessen the nuclear threat and roll back the specter of a warming planet," Obama said four years ago. But today's mention seems to be the most extended case for action on climate change in any inaugural address in recent history.

    Climate change was a huge part of Obama's presidential agenda, until it got derailed midway through his first term.

    When Obama came into office, his legislative agenda included three major pillars - health care, energy, and education reform - as advertised by staffers at Organizing for America, the post-campaign apparatus tasked with pushing his priorities through Congress. As we saw, only health care got through Congress.

    A climate-change bill, in fact, helped sink Democrats in 2010.

    As prospects looked murkier for a climate bill in the slow-footed Senate, then-House-Speaker Nancy Pelosi called a vote on a climate bill that included a cap-and-trade system for limiting carbon emissions. It passed, 219 to 212, on June 26, 2009, with 211 Democrats voting in favor.

    Energy reform ultimately stalled in the Senate, and the House vote proved a major political liability: Republican candidates, party committees, and outside groups hammered Democrats across the country for supporting the "cap and tax" agenda, decrying the idea of taxing businesses for emissions in a bad economy. Without action in the Senate, the Democrats' climate push proved costly politically: Democrats lost enough House seats in 2010 to hand the majority over to Republicans.

    Heading into Obama's second term, near-term action on energy seems unlikely. Republicans still hold the House majority, and the makeup of the Senate has not changed significantly, meaning the prospects of energy reform have actually dimmed since the effort failed in 2009 and 2010 - when Democrats controlled both houses.

    Obama's inaugural address may not signal that he intends to push legislation through Congress, unless Democrats can retake the House of Representatives, but it comes at a peculiar moment for climate-change politics: Superstorm Sandy confirmed to some that climate change is a real, tangible threat that requires immediate action, even though the legislative numbers don't quite add up.

    AP sources: Maloofs agree to sell Kings

    Two people familiar with the decision says the Maloof family has agreed to sell the Sacramento Kings to a Seattle group led by investor Chris Hansen.

    The people spoke on condition of anonymity to The Associated Press on Sunday night because the deal is still pending approval from the NBA Board of Governors.

    One person said the Maloofs are selling all 65 percent of their share for $525 million to Hansen, who will move the team to Seattle and restore the SuperSonics name.

    The Maloofs will still be allowed to look at other bids until the league approves the sale.

    Sacramento Mayor Kevin Johnson said last week he had received permission from NBA Commissioner David Stern to present a counteroffer to league owners from buyers who would keep the Kings in Sacramento.

    The deadline for teams to apply for a move for the next season is March 1.

    All the speculation is about to end. In a matter of hours, viewers can judge for themselves whether Lance Armstrong told the truth this time.

    Armstrong's confession to Oprah Winfrey about using performance-enhancing drugs to win the Tour de France a record seven times in a row will be televised at 9 p.m. Thursday, the first segment of a two-part special on the Oprah Winfrey Network. Since word of his confession during Monday's taping in Austin, Texas, was first reported by The Associated Press, there has been no shortage of opinions or advice on what Armstrong should say.

    The International Olympic Committee didn't wait to listen.

    The IOC on Wednesday stripped Armstrong of his 2000 bronze medal, sending him a letter asking him to return it, according to officials who spoke on condition of anonymity because the decision had not been announced.

    For others who will tune in Thursday, it's not just what Armstrong said that matters. How he said it, whether angry, tearful or matter-of-fact, will be judged as well.

    "I left it all on the table with her and when it airs the people can decide," Armstrong said of his interview in a text sent to the AP on Wednesday. He dismissed a story earlier in the day that described him as "not contrite" when he acknowledged doping while dominating the cycling world.

    Livestrong, the cancer charity Armstrong founded in 1997 and was forced to walk away from last year, said in a statement it expected him to be "completely truthful and forthcoming." A day earlier, World Anti-Doping Agency director general David Howman said nothing short of a confession under oath ? "not talking to a talk-show host" ? could prompt a reconsideration of Armstrong's lifetime ban from sanctioned events. And Frankie Andreu, a former teammate that Armstrong turned on, said the disgraced cyclist had an obligation to tell all he knew and help clean up the sport.

    "I have no idea what the future holds other than me holding my kids," Armstrong said in the text.

    Armstrong has held conversations with officials from the U.S. Anti-Doping Agency, including a reportedly contentious face-to-face meeting with USADA chief executive Travis Tygart near the Denver airport. It was USADA's 1,000-page report last year, including testimony from nearly a dozen former teammates, that portrayed Armstrong as the leader of a sophisticated doping ring that propelled the U.S. Postal Service team to title after title at the Tour de France. In addition to the lifetime ban, Armstrong was stripped of all seven wins, lost nearly all of his endorsements and was forced to cut ties with Livestrong.

    According to a person with knowledge of the situation, Armstrong has information that might lead to his ban being reduced to eight years. That would make him eligible to compete in elite triathlons, many of which are sanctioned under world anti-doping rules, in 2020, when Armstrong will be 49. He was a professional athlete in the three-discipline sport as a teenager, and returned to competition after retiring from cycling in 2011.

    That person also said the bar for Armstrong's redemption is higher now than when the case was open, a time during which he refused to speak to investigators. The person spoke on condition of anonymity because he was discussing a confidential matter.

    Armstrong, who always prized loyalty on his racing teams, now faces some very tough choices himself: whether to cooperate and name those who may have aided, abetted or helped cover up the long-time use of PEDs.

    Armstrong left his hometown of Austin, where the interview was taped at a downtown hotel, and is in Hawaii. He is named as a defendant in at least two pending lawsuits, and possibly a third. The Justice Department faces a Thursday deadline on whether to join a whistle-blower lawsuit filed by former teammate Floyd Landis, who was stripped of the 2006 Tour de France title for doping.

    That suit alleges Armstrong defrauded the U.S. government by repeatedly denying he used performance-enhancing drugs. Armstrong could be required to return substantial sponsorship fees and pay a hefty fine. The AP reported earlier that Justice Department officials were likely to join the lawsuit.

    "There is no doubt that our countries are free to?identify their own priorities with regard to?the European Union. At?the same time, we share a?common interest in?building a?unified Europe with no dividing lines," Lavrov said at?a news conference Sunday afternoon.

    "We see no contradiction between our countries' rapprochement with Europe and?the intensifying multi-format cooperation within the?Commonwealth of?Independent States. These two developments complement rather than oppose each other," Lavrov said.

    The?meeting took place at?the National University in?the town of?Chernivtsi, on?the border with Romania. The?town is widely viewed as a?cultural center of?western Ukraine, which is well known for?widespread resentment of?Russian influence among its population.

    The?area around the?university was blocked as the?police tried to?prevent the?protesters from?approaching the?main building. Members of?the nationalist Svoboda party gathered in?the center of?town shouting, "Ukraine's future lies with Europe," and, "Say no to?economic slavery!" the?BBC reported.

    On?Monday the?two ministers laid flowers on?a monument to?popular 19th-century Ukrainian poet Taras Shevchenko. Later they met with the?students and?faculty of?the National University, where both were awarded honorary degrees for?their efforts to?put the?university's architectural complex on?the UNESCO World Heritage List.

    "Both Ukraine and?Russia are interested in?unification rather than in?deepening a?gap between them," Kozhara, who was appointed foreign minister on?Dec. 24, said in?comments carried by?Itar-Tass. "In any case, a?common market between the?East and?the West would meet the?interests of?all and?would be a?proper answer to?the challenges we face. But for?these ends, Europe should overcome ideological barriers. The?European split must become history."

    Lavrov responded by?saying "integration on?the continent, both in?terms of?the European and?Eurasian unions, develops according to?the same rules. Therefore we must facilitate their pairing rather than oppose these processes."

    Konstantin Zatulin, head of?the CIS Institute and?a former State Duma deputy, told The?Moscow Times that Ukraine "has limited time to?make a?definite choice between the?Customs Union and?the EU. Its economic situation is catastrophic, and?thus it can no longer afford the?multi-vector policy it pursued since the?collapse of?the Soviet Union."

    In?Zatulin's opinion, the?main purpose of?the Chernivtsi talks was for?the new Ukrainian foreign minister to?get introduced to?Lavrov and?that specific decisions are to?be expected at?subsequent meetings. Lavrov invited Kozhara to?visit him in?Moscow in?the summertime.

    iPhone 5 users are Europe's biggest data consumers

    LONDON (Reuters) - Users of Apple's iPhone 5, launched in September 2012, have the most voracious appetite for data in Europe, consuming on average more than four times the amount of a typical person still using a iPhone 3G, according to a study.

    Mobile data analysis firm Arieso examined more than 1 million smartphone users on European 3G networks over a 24 hour period to gauge data demand.

    It found that newer smartphones, tablets and devices that fall in between in terms of screen size and capability, dubbed "phablets", were creating ever growing demands for data, putting increasing pressure on 3G mobile networks.

    "One iPhone 5 user is effectively worth about 4 iPhone 3G users," report author Michael Flanagan said in an interview.

    The study also found iPhone 5 users demanded 50 percent more data than iPhone 4S users, who were the most demanding a year ago, he said.

    The amount of data uploaded to services like social networking sites had also increased, he said, and it was now one sixth of the amount of data downloaded against one seventh a year ago.

    Samsung's Galaxy SIII smartphone, edged ahead of the iPhone 5 in terms of the average amount of data generated and uploaded by the device, for example in posting a photograph to Facebook.

    1.?Eye contact is key. Always remember to maintain eye contact with your interviewer, as confidence and leadership are always interpreted by your consistent attentiveness and willingness to remain focused.

    2.?Start things off with a firm handshake.?First impressions can make or break the rest of your interview, but don?t overdue it. Remember to grip your interviewer?s hand only as hard has he grips yours, no more and no less.

    3.?Avoid wearing excessive makeup or strong colognes/perfumes. You want to be perceived as professional and anything that is perceived to be cheap or unnecessary will detract from your character. Just be presentable and hygienic.

    5. Speak slowly and clearly. A mistake made often too often, unbeknownst to the person actually speaking, is the habit of talking too quickly and fumbling over your words. Don?t drop the ball when it comes to your speech. Practicing in the mirror before an interview can help keep your speech speed and annunciation in check.

    6.?VERY IMPORTANT: THINK BEFORE YOU SPEAK.?You may think it is the right thing to do by answering a question almost immediately in order to appear prepared and knowledgeable during the course of your interview, but this can lead to disaster.

    7.?Be prepared to ask questions.?Simply put, when it is appropriate to ask, you should ask your interviewer some questions of your own, so long as they relate to the interview or company you are interviewing for.

    8.?Never interrupt the interviewer; find the right moment to speak.?Though it may seem like a difficult balance between listening and knowing when to say something, in truth it doesn?t take much effort at all. Practice with a friend or family member beforehand so that jumping into the interview becomes a snap.

    9.?Be yourself.?Although it may sound like a clich? you are doing yourself a huge favor by not forcing yourself into a false persona or pretending to be more than you are.

    10.?VERY IMPORTANT: AFTER EVERY INTERVIEW, E-MAIL THEM BACK AND THANK THEM FOR THEIR TIME.?It may come as a shock to you but most people forget this simple step and it costs them dearly. Remember this simple step and the nine others before it and you should be fine.
